1. Introduction

Stackryn LLC ("we", "us", "our") operates the Stackryn modernization intelligence platform (the “Platform”) and provides related services (together with the Platform, the “Service"). This Privacy Policy explains how we collect, use, store, and protect your information when you use the Service.

By using the Service, you consent to the data practices described in this policy. If you are using the Service on behalf of an organization, you confirm that you have authority to consent on their behalf.

2. Data We Collect

We collect information from you in a variety of ways depending on how you interact with us and our websites, platforms, products and services, including:

• Directly from you when you provide it to us, such as when you register for an account, sign up to receive communications from us, or contact us by phone, email or otherwise.
• Automatically through the use of cookies, server logs, and other similar technologies when you interact with our websites, advertisements, and emails.
• From other sources, including, for example, our affiliates, business partners, service providers, online social media networks, and other third parties, or from publicly available sources. For example, if you submit a job application, or become an employee, we may conduct a background check.

The following provides examples of the type of information that we collect in a variety of contexts.

2.1 Account Information

When you create an account, we collect your email address, display name, and organization affiliation.

2.2 Initiative and Project Data

Data you enter into the Service, including: initiative context (strategic goals, constraints, success criteria), internal systems inventory, platform evaluations, functional requirements (L1/L2), evidence documents, stakeholder information, and decision records may contain personal information on your personnel, service providers, and other stakeholders.

2.3 AI Interaction Data

When you use AI-powered features (chat agent, requirement extraction, platform fit analysis), we process your prompts and the content you submit for analysis. AI interaction logs may be retained for service improvement and audit purposes.

2.4 Usage Data

When you interact with our websites or the Service, we may collect standard usage and technical information, including pages viewed, features and interactions, session duration, referring source, browser and device information, approximate location, and diagnostic or error data. We use this information to understand usage, improve the Service, measure website performance, and detect and prevent fraud or misuse.

We use Google Analytics 4 on our public website to understand website traffic, engagement, and lead-generation performance. Our analytics implementation is configured so that we do not intentionally send names, email addresses, form contents, or other directly identifying information submitted through website forms to Google Analytics.

2.5 Cookies and Tracking Technologies

We use essential cookies and analytics technologies. Essential cookies support functionality such as authentication, security, and session management. We also use Google Analytics 4, which may use first-party cookies, including cookies such as _ga, to distinguish users and sessions and measure how visitors interact with our public website.

Google may process website usage information on our behalf in connection with the Google Analytics service. We currently use Google Analytics for website measurement and performance analysis and not for personalized advertising or remarketing.

2.6 Email Connectivity

If you receive email from us, we use certain tools to capture data related to when you open our message, click on any links or banners it contains.

2.7 Employment

If you apply for a job posting, or become an employee, we collect information necessary to process your application or to retain you as an employee. This may include, among other things, your Social Security Number. Providing this information is required for employment.

2.8 Mailing List

When you sign up for one of our mailing lists we collect your email address.

2.9 Feedback/Support

If you provide us feedback or contact us for support we will collect your name and email address, as well as any other content that you send to us, in order to reply.

3. How We Use Your Data

• To provide, maintain, and improve the Service
• To process your content through AI features and generate recommendations
• To authenticate users and enforce multi-tenancy data isolation
• To communicate service updates, security notices, and support responses
• To conduct analytics
• To send marketing and promotional materials relating to our products, services, promotions, or those of our business partners
• To detect and prevent abuse, fraud, security threats, and illegal activity, including violation of our policies and terms and conditions
• To debug, identify and repair errors that impair existing functionality of the Service
• To comply with legal or regulatory obligations, to establish or exercise our rights, and to defend against a legal claim
• For administrative purposes, as well as to manage our relationships
• For such other purposes as you may consent

4. How We Share Your Information

In addition to the specific situations discussed elsewhere in this Privacy Policy, we may disclose personal information in the following situations:

• Affiliates and Acquisitions. We may share information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). If another company acquires, or plans to acquire, our company, business, or our assets, we will also share information with that company, including at the negotiation stage.
• Other Disclosures without Your Consent. We may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the shipment of products to or the provision of services by a third-party intermediary.
• Public. Some of our websites may provide the opportunity to post comments, or reviews, in a public forum. If you decide to submit information on these pages, that information may be publicly available.
• Partner Promotion. We may offer promotions with third party partners. If you decide to enter a promotion that is sponsored by a third party partner the information that you provide will be shared with us and with them. Their use of your information is not governed by this privacy policy.
• Service Providers. We may share your information with service providers. Among other things service providers may help us to administer our website, support our Platform, provide technical support, process payments, and assist in the fulfillment of orders. We use Google Analytics, provided by Google, as a service provider to measure website usage and performance.
• Other Disclosures with Your Consent. We may disclose your information to other third parties when we have your consent or direction to do so.

5. Data Retention

We retain your personal information for only as long as necessary to fulfil the purposes outlined in this Privacy Policy, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless a longer retention period is required or permitted by law. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we obtained the information and whether we can achieve those purposes through other means, as well as applicable legal requirements. For example:

• We retain your data for as long as your account is active and as needed thereafter for operational and archival purposes. Upon account termination, data can be exported for up to 90 days.
• AI interaction logs are typically retained for up to 12 months for audit and service improvement purposes.

6. Data Security

We implement industry-standard security measures including: encryption in transit (TLS), encryption at rest, row-level security (RLS) for multi-tenant data isolation, role-based access control (RBAC), and regular security assessments. See our security documentation for details.

No method of transmission over the internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. In the event that we are required by law to inform you of a breach to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Some of our websites permit you to create an account. When you do you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. You should notify us of any unauthorized use of your password or account.

7. Your Rights

Depending on your jurisdiction, you may have the right to:

• Changes To Your Personal Information. We rely on you to update and correct your personal information. Most of our websites and the Platform allow you to modify or delete your account profile. If our website does not permit you to update or correct certain information, you can contact us at the address described below in order to request that your information be modified. Note that we may keep historical information in our backup files as permitted by law.
• Promotional Emails. You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions in emails that you receive. If you decide not to receive promotional emails, we may still send you service related communications.
• Promotional Text Messages. If you receive a text message from us that contains promotional information you can opt-out of receiving future text messages by replying “STOP.”

8. Cookies and Tracking

STACKRYN uses essential cookies and Google Analytics 4 analytics cookies on its public website. Analytics helps us understand website traffic, traffic sources, content performance, user interactions, and successful demo-request conversions so that we can improve our website and services.

You can control or delete cookies through your browser settings. Where applicable law requires consent before non-essential cookies or similar technologies are used, we will provide appropriate choices and honor those selections.

We do not currently use advertising cookies or third-party remarketing trackers on the STACKRYN public website.

9. Children’s Privacy

The Service is designed for business use and is not directed at individuals under the age of 13. We do not knowingly collect personal information from children under 16. Children under the age of 13 should not provide their personal information to us.

10. Changes to This Policy

We may update this Privacy Policy to reflect changes in our practices or legal requirements. It is your responsibility to review changes before continuing to use the Service. We will notify you of material changes via email or in-app notice before they take effect.
